THE BRADY LIST

Information The District Attorney's Office established the Los Santos County Brady List to ensure the truthfulness of government officials throughout the various law enforcement departments within the county of Los Santos, as well as to comply with the Brady v. Maryland Supreme Court of the United States case. Effective immediately, the Brady list will be accessible to the public and can be used in court proceedings, serving as vital evidence that can exonerate an otherwise innocent defendant. Peace Officers can only be put on the list if they grossly violate their department policies or the law or show intentional untruthfulness during administrative or criminal proceedings.

However, the District Attorney's Office will only submit names to the list for administrative proceedings if requested directly by the Department's Internal Affairs with adequate evidence provided. All evidence of wrongdoing will be made public. The District Attorney's Office will allow the officer in question to get their name removed from the List after 3 years (( 90 days )) of being put on the list.

Alternatively, the officer can directly appeal the decision of being put on the list to the District Attorney's Office and present their case.

Addition Process The process of adding someone to the Brady List is taken very seriously by the District Attorney's Office due to the potential consequences that the officer in question may face. However, if the officer in question exhibits the very specific characteristics required to be on the list, the District Attorney's Office will not hesitate to add the said individual to the list to preserve public safety and trust. The following are the reasons an officer may be put on the Brady List and are limited to only these reasons:
  • False Statements: Any officer supplying false statements to judicial or executive entities, such as false statements on an arrest report, false testimony to the District Attorney's Office, or false statements to the department's Internal Affairs in criminal or administrative proceedings.

  • Obstruction of Judicial Entities: Any officer who intentionally obstructs the proceedings of a judicial entity through the use of coercion, violence, or by abusing their position as a peace officer, and delays any court proceedings or investigation being conducted by a judicial entity.

  • Withholding Evidence: Any officer who willfully withholds exonerating or convicting evidence shall also be put on the Brady List under the Brady Violation: Obstruction of Judicial Entities.

  • Gang Activity: Any officer proven to be a part of or an associate of a violent street gang or an established group of police officers acting for the benefit of the group rather than the public and neglecting to uphold their duties as peace officers.

  • Criminal Conviction: Any officer convicted of a violent misdemeanor charge or a felony of any type.

Only a few sworn government officials within the Los Santos County District Attorney's Office can apply for a Brady List addition. If a department wants one of its employees or previous employees added to the list, the evidence must be forwarded to one of the managers of the list:
